ABSTRACT

Introduction. The objective of this article is to demonstrate how expert evidence fulfills a significant function within a criminal process, since through it, it can be reconstructed and, in turn, prove or disprove a given fact, in order to get closer or reach it. to the truth, as long as it is used timely and meets the technical-scientific requirements in its execution. Through a real case, the consequences that result from the Public Prosecutor's Office not requesting expert opinions and the reconstruction of the event will be known to verify the veracity of the statements and understand the event; Likewise, the defense attorney did not use those resources to support his defense; Also, methodological and legal breaches committed by official experts when investigating and carrying out their procedures will be shown.
Conclusion. The irregularities in the investigation by the Public Prosecutor and the official experts, as well as the negligence of the defense lawyer, caused a person to be declared guilty, violating his Human Rights to the administration of justice and freedom.
