Medical-legal aspects: ''what should the general surgeon need to know''

ABSTRACT

For medical specialists, understanding medico-legal aspects is essential to ensure a safe, ethical, and legally compliant medical practice. In Mexico, the Ministry of Health (SSA) and COFEPRIS are the primary entities responsible for overseeing and regulating medical practice, ensuring adherence to critical regulations such as the General Health Law and the Federal Law on Protection of Personal Data Held by Private Parties. These regulations safeguard both patients and healthcare professionals from potential litigation and sanctions. The training of general surgeons requires a comprehensive education that includes the understanding and application of ethical and legal principles, ensuring respect for patients' rights, confidentiality of medical data, and proper clinical documentation. Various studies emphasize the importance of patient-centered care based on ethical and legal standards to enhance service quality and patient safety. Failure to comply with these regulations can result in severe penalties, including fines, license suspension, and even criminal charges. For these reasons, staying informed and up-to-date on medico-legal aspects is crucial for maintaining high standards in medical care and fostering an efficient and humane healthcare system.
