Medical Malpractice and / or Corruption? Study of a case

ABSTRACT

Introduction. The clinician who examines an injured person must provide a medical summary that can be included in a legal matter for evidentiary purposes. This is due to the fact the aforementioned document is to be integrated into the Investigation Folder, and is a piece of evidence that will help the Public Prosecutor to know the existence of an event, if that fact is a crime and if the accused committed it or participated in its commission; thus, the documents issued by the clinicians are medical-legal documents.
Discussion. A real case is studied in which there are opinions made by private clinicians and by a Prosecutor's doctor, which are evidently contradictory, and somehow suggest that some of them may have incurred in Medical Bad Practice and, inclusively, in possible acts of corruption. Within this reference framework it is specified what these concepts and factors are, and how they can influence and show the veracity or falsity of a medical-legal document.
Conclusion. A doctor, when issuing a medical-legal document, where a professional opinion about the injuries in a patient is stated, must structure it based on Medical Propaedeutics and semiology, which will guarantee their fidelity, veracity and protection of the human rights of the people in a legal problem.
