ABSTRACT

The odontologist faces situations that require the application of bioethical concepts, since this practice is managed by the same scientific, ethical and legal principles as the medical act. About any image taken of the body in orthodontic treatment, it is necessary to understand their right to privacy, right to the image and right to information. Mexican legislation provides that photographic, audiovisual or audio images generated in health care, form part of the clinical record, being protected by the legal framework and the right to data protection in possession of individuals or government institutions. The photographs contained in the patient’s clinical record are sensitive personal data; this highlights the importance of informed consent as a powerful implement to ensure the recognition of the dignity through a dialogical relationship, in addition to contributing to patient health education through responsibility for their rights safeguarded by legal doctrine.
