Legal Shielding in Health Sciences: Informed Consent

ABSTRACT

Introduction. The aim of this research article is to know the legal shielding to protect health professionals working in the public, private and social sector, mainly to prevent short, medium and long term conflicts of health service users, through the proper procedure of informed consent. Objectives. To recognize legal shielding in health sciences and to implement legal shielding in informed consent to protect health professionals working in the public, private and social sectors. Material and methods. Empirical study in which the importance of informed consent is analyzed through the adequate process of information, emphasizing that validly informed consent is a human right of the users of health services, in addition to having ethical and legal requirements for the health professional. Results. The study is conducted from the incorporation of the Sustainable Development Goals (SDGs) and integrates Goal 3: Ensure healthy lives and promote well-being for all at all ages; Goal 4: Ensure inclusive, equitable and quality education and promote lifelong learning opportunities for all and Goal 16: Promote just, peaceful and inclusive societies for Health Sciences for incorporation into informed consent through the triple helix innovation model. Discussion. By performing an adequate informed consent, the human right to health of health service users will be guaranteed, in addition to ensuring justice in public, private and social institutions. Conclusions. The health professional should be aware of recognizing the rights and obligations of his profession and his medical responsibility.
