Medical Liability: Between Freedom and Solidarity with the Patient

ABSTRACT

The dichotomy created by the use of medical technology and its consequences in the field of physician-patient relationship leads to the following questions: What is the sense of responsibility of the physician in your practice? What about the patient regarding disease and health? Does responsibility help to shape an ethos in which a practical rationality lies, and as Adela Cortina said, would it be a responsible and supportive ethos? In order to explore the link between the principle of liability and medical practice arising from the doctor-patient encounter, this paper provides elements to define the sense to understand the medical liability and their relationships with medical practice and freedom from the horizon of understanding composed by ethical positions of Aristotle, Kant, Weber, Hans Jonas, Adela Cortina, and Gadamer. The analysis of medical liability from medical encounter and freedom leads to identify practical solidarity next to the recognition of the other in an extension of love and compassion, to finally conclude that prohairesis and phronesis, are elements of practical solidarity underlying medical liability of the medical ethos.
