Access to the clinical files in Medical Attention Establishments in Mexico for investigation purposes

ABSTRACT

Introduction: The clinical file is used in health investigation as its «property, record and access» facing the obligation of the center to protect the privacy of information. Objective: Identify the process of access to the clinical file in Medical Attention Establishments (MAE) in Mexico that conduct investigation and utilize it as a source of information. Material and methods: Transversal design, carried out through the request of information in Transparency portals of the MAE at a national level, analized by statistics of frequency. Results: 177 public MAE informed, out of which the 83% use the clinical file as a source of information in investigation. In 99.3% of the MAE a protocol of investigation is requested, being the Committee of Ethics in Investigation and/or the Committee of Investigation the ones in which 56.8%% of the cases authorize the access, the rest is authorized by the director, Education Chief, Archives Chief, Service Chief, the Juridical Direction of Health Services, and in 6.2% by the patient. Conclusions: The Mexican normativity defines the information of the clinical file as personal data and sensitive personal data, being the patient the holder of this information, reason why the access, management, obtention, use, dissemination, recording procedures, utilization or transfer is subjected to the consent of the holder, showing the obtained results that only 6.2% of the establishments that informed comply with Federal regulations.
